Selly – Terms & Conditions

Welcome to Selly! These Terms and Conditions ("Terms") govern your access to and use of the Selly mobile application and related services (the "App" or "Service") operated by BRK Technologies LLC ("Company", "we", "us", or "our").

By downloading, accessing, or using Selly, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use the App.

Description of Service

Selly is a mobile application that provides daily updated content cards featuring business tips, affirmations, book summaries, audiobooks, meditations, word puzzles, motivational content, fitness routines, and third-party videos. Our services are designed for personal growth, education, and entertainment, and are for your personal, non-commercial use only.

Privacy Policy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, protect, and handle your personal data and information. By using the App, you consent to the practices described in the Privacy Policy.

Account Registration and Age Requirement

You must be at least 13 years old to create an account and use the App. By using Selly, you represent and warrant that you meet this age requirement. You agree to provide accurate and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account and password.

Subscriptions, Free Trials, and Cancellations

Selly may offer auto-renewing subscriptions to provide full access to premium daily cards and library content.

Pricing and Payment: Subscription fees are clearly stated within the App, and payment will be charged to your Apple ID account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings after purchase. Deleting the App from your device does not cancel your subscription.
Free Trial: If a free trial period is offered, it will automatically convert into a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial ends.

Book Summaries and Copyright Disclaimer

Selly provides summaries, analyses, and condensed versions of non-fiction books. We do not provide the original books. The summaries and related content provided in the App are strictly for educational and informational purposes.

        Selly and BRK Technologies LLC are not affiliated with, authorized, approved, licensed, or endorsed by the original authors, publishers, or copyright holders of the books summarized in the App.
      

Third-Party Content and Services

The App may display, include, or make available third-party content, including but not limited to videos fetched directly from third-party platforms (e.g., TikTok via API), or provide links to third-party websites. You acknowledge and agree that the Company does not claim ownership of this third-party content. Your use of such content within Selly is subject to the terms and conditions of the respective third-party platforms.

Health, Fitness, and Professional Disclaimer

The content provided in Selly, including but not limited to fitness routines, workout tips, meditation exercises, and nutritional information, is for general informational and entertainment purposes only. It does not constitute medical or physical health advice.

Always consult with a qualified healthcare professional or physician before starting any new fitness program or making changes to your diet. BRK Technologies LLC is not responsible for any injuries or health issues that may result from following the fitness or health-related content in the App. Business and financial tips provided in the App do not constitute professional financial or legal advice.

User-Generated Content (Profile Pictures)

Users may have the option to upload a profile picture. You are solely responsible for the images you upload. You agree not to upload any imagery that is offensive, unlawful, explicitly sexual, violent, or infringes upon the intellectual property rights of others.

BRK Technologies LLC reserves the right, at its sole discretion and without prior notice, to review, monitor, and remove any user-generated content that violates these Terms or is deemed inappropriate.

Intellectual Property Rights

Excluding third-party content, user-generated profile pictures, and original book copyrights mentioned above, all original text, graphics, quizzes, logos, software, and other materials created for the Selly app are the property of BRK Technologies LLC. You are granted only a limited, non-transferable license to use the App for personal purposes.

User Obligations

While using the App, you agree not to:

Engage in any illegal, fraudulent, or unauthorized activities.
Take any actions that would disrupt, damage, or overburden the App's operation or servers.
Attempt to gain unauthorized access to other users' data or accounts.

Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following terms apply:

        You acknowledge that these Terms are concluded between you and BRK Technologies LLC only, and not with Apple Inc. ("Apple"). BRK Technologies LLC, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the App. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms.
      

Limitation of Liability

To the maximum extent permitted by applicable law, BRK Technologies LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, the content provided within the daily cards, or your reliance on any summaries, fitness routines, or tips presented.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE) and the Emirate of Sharjah. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any significant changes via the App or email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
